Terms of Service

1. Acceptance of Terms

By accessing or using FoodTrucker ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

FoodTrucker is a mobile and web platform that connects customers with local food trucks. We provide a marketplace where customers can discover food trucks on an interactive map, view menus and weekly schedules, read reviews, follow their favorite trucks, receive notifications when trucks go live, and place orders for pickup. The Service is available as a mobile app (iOS and Android) and at foodtrucker.co.

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for:

  • Providing accurate and complete information
  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

4. Orders and Payments

When you place an order through FoodTrucker:

  • You are entering into a transaction with the food truck operator, with FoodTrucker facilitating the payment
  • Prices, availability, and preparation times are set by the food truck
  • Payment is processed securely through the app via Stripe at the time of order. Payments are routed using Stripe Connect destination charges: the food truck operator receives their share (subtotal, applicable tax, and any tips) directly to their connected Stripe Express account, while FoodTrucker retains an 8% service fee on each order
  • Your order is confirmed once payment is successfully processed
  • The service fee, tax, and tip breakdown are displayed at checkout before you complete your purchase — no hidden charges
  • Tips are optional and go directly to the food truck operator (100%)

5. Cancellations and Refunds

Our cancellation and refund policy:

  • Before order confirmation: Orders may be cancelled for a full refund if the food truck has not yet started preparing your order
  • After preparation begins: Refunds are at the discretion of the food truck operator
  • Quality issues: If you receive an incorrect or unsatisfactory order, please contact us within 24 hours at contact@foodtrucker.co
  • Refund timing: Approved refunds are processed within 5-10 business days and will appear on your original payment method

6. Food Truck Operators

Food truck operators using our platform agree to:

  • Maintain all required licenses and permits
  • Provide accurate menu information and pricing
  • Fulfill orders in a timely manner
  • Comply with all applicable food safety regulations
  • Handle customer data responsibly
  • Complete the mandatory onboarding process before going live, which includes providing truck details, uploading a truck photo, creating a menu (manually or by importing from Square POS), and connecting a Stripe Express account to receive payments
  • Verify their email address during signup via a verification code sent to the email on file
  • Connect a valid Stripe Express account via Stripe Connect to receive payments. Trucks cannot accept orders or go live without an active Stripe Connect account
  • Acknowledge that FoodTrucker retains an 8% service fee on each transaction, with the remainder (subtotal, tax, and tips) deposited directly to the operator's connected Stripe account
  • If opting to connect Square POS, ensure their Square account is in good standing. Menu items and photos may be imported from Square, and orders placed through FoodTrucker will appear in the operator's Square POS. Inventory and sold-out status sync bidirectionally between FoodTrucker and Square
  • Ensure that any images uploaded (truck photos, menu item photos) are owned by the operator or properly licensed for use. Uploaded truck photos may have background removal applied automatically
  • Keep their weekly schedule and check-in status accurate and up to date

7. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Impersonate any person or entity
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to any portion of the Service
  • Use automated means to access the Service without permission
  • Submit false or misleading information

8. User Content

You may submit content through the Service, including reviews, ratings, questions, photos, and other materials ("User Content"). By submitting User Content, you:

  • Grant FoodTrucker a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content in connection with the Service
  • Represent that you own or have the necessary rights to the content you submit
  • Agree not to submit content that is false, misleading, defamatory, obscene, or otherwise objectionable
  • Acknowledge that FoodTrucker may remove User Content that violates these terms or is deemed inappropriate

9. Communications

By using the Service, you may receive communications through the following channels:

9.1 SMS Text Messages

By providing your phone number and verifying it, you consent to receive SMS notifications related to your orders and account. These may include:

  • Order status updates (e.g., order confirmed, ready for pickup)
  • Phone number verification codes

Message frequency varies based on your order activity. Message and data rates may apply. You can opt out of SMS notifications at any time by replying STOP to any message. After opting out, you will no longer receive SMS notifications but may still receive push notifications and emails. Reply HELP for assistance. Carriers are not liable for delayed or undelivered messages.

9.2 Push Notifications

With your consent, FoodTrucker may send push notifications to your device. These may include:

  • Order status updates (e.g., order confirmed, preparing, ready for pickup)
  • Notifications when food trucks you follow go live or post updates
  • Promotional offers from trucks you follow

You can manage or disable push notifications at any time through your device settings or the app's notification preferences.

9.3 Email

We send transactional emails for order receipts, password resets, email verification codes, and important account communications. Food truck operators are required to verify their email address during signup by entering a 6-digit verification code sent via email. You may also receive occasional promotional emails, which you can opt out of by clicking "unsubscribe" in any marketing email.

10. Intellectual Property

The Service and its original content, features, and functionality are owned by FoodTrucker and are protected by international copyright, trademark, and other intellectual property laws.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for the quality, safety, or legality of food provided by food truck operators.

12. Limitation of Liability

To the maximum extent permitted by law, FoodTrucker shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes by posting a notice on the Service. Continued use after changes constitutes acceptance of the new terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules, except that you may assert claims in small claims court if your claims qualify.

You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. The arbitrator's decision shall be final and binding.
