1. Acceptance of Terms

By accessing or using FoodTrucker ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

FoodTrucker is a mobile platform that connects customers with local food trucks. We provide a marketplace where customers can discover food trucks, view menus, and place orders for pickup.

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for:

  • Providing accurate and complete information
  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

4. Orders and Payments

When you place an order through FoodTrucker:

  • You are entering into a transaction with the food truck operator, with FoodTrucker facilitating the payment
  • Prices, availability, and preparation times are set by the food truck
  • Payment is processed securely through the app via Stripe at the time of order
  • Your order is confirmed once payment is successfully processed
  • FoodTrucker charges a service fee on each order, which is displayed at checkout before you complete your purchase
  • Tips are optional and go directly to the food truck operator (100%)

5. Cancellations and Refunds

Our cancellation and refund policy:

  • Before order confirmation: Orders may be cancelled for a full refund if the food truck has not yet started preparing your order
  • After preparation begins: Refunds are at the discretion of the food truck operator
  • Quality issues: If you receive an incorrect or unsatisfactory order, please contact us within 24 hours at contact@foodtrucker.co
  • Refund timing: Approved refunds are processed within 5-10 business days and will appear on your original payment method

6. Food Truck Operators

Food truck operators using our platform agree to:

  • Maintain all required licenses and permits
  • Provide accurate menu information and pricing
  • Fulfill orders in a timely manner
  • Comply with all applicable food safety regulations
  • Handle customer data responsibly
  • Connect a valid Stripe account to receive payments
  • Acknowledge that FoodTrucker retains a service fee on each transaction as specified in the operator agreement

7. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Impersonate any person or entity
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to any portion of the Service
  • Use automated means to access the Service without permission
  • Submit false or misleading information

8. SMS Text Messages and Communications

By providing your phone number and consenting to receive text messages, you agree to receive SMS notifications from FoodTrucker related to your orders and account. These may include:

  • Order status updates (e.g., order confirmed, ready for pickup)
  • Account verification codes

Message frequency varies based on your order activity. Message and data rates may apply. You can opt out of SMS notifications at any time by replying STOP to any message. After opting out, you will no longer receive SMS notifications but may still receive push notifications if enabled. Reply HELP for assistance. SMS notifications are provided by Twilio. Carriers are not liable for delayed or undelivered messages.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by FoodTrucker and are protected by international copyright, trademark, and other intellectual property laws.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for the quality, safety, or legality of food provided by food truck operators.

11. Limitation of Liability

To the maximum extent permitted by law, FoodTrucker shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes by posting a notice on the Service. Continued use after changes constitutes acceptance of the new terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules, except that you may assert claims in small claims court if your claims qualify.

You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. The arbitrator's decision shall be final and binding.
